International Visitor Card Terms and Conditions

  

1) The International Visitors Card allows the Cardholder to benefit from exclusive advantages and special opportunities promoted and managed by la Rinascente S.p.a. at la Rinascente points of sale or on the website www.rinascente.it

 

2) The exclusive benefits for Cardholders are:

access to promotions all year round, with discounts on brands taking part in the initiative;

free consultancy provided by our beauty consultants and fashion stylists;

invitations to exclusive events, that might be held during your stay in Italy (Please note: you must fill in the fields related to your trip to Italy that can be found in the “Get Your Card” or “My Area / Edit your profile” sections, if you want to receive your invitation).

 

3) The International Visitors Card is exclusively designed for subjects who are not involved in entrepreneurial or professional activities, not resident or domiciled in Italy.

 

4) The International Visitors Card is released completely free of charge, upon filling in the dedicated form. Providing incomplete or untrue data which are necessary for card release will result in the impossibility to release the card or in the cancellation of the card itself.

 

5) The regulations to participate to promotional offers and discounts all year round are communicated to the Cardholder by means of information to be found at la Rinascente points of sale, on the website www.rinascente.it, and through other channels such as e-mails.

 

6) To benefit from the exclusive advantages during in-store purchases it is necessary to present at the cash desk the International Visitors Card or its code number or to indicate your personal data (as the holder of the International Visitors Card) to search for your customer code in the CRM, with a valid foreign passport. Failure to present the card, or the customer code, or login to the site before payment does not allow the calculation of discounts, not even at a later time.

 

7) la Rinascente reserves the right to modify or interrupt loyalty building activities at any time without notice and at its discretion, blocking the International Visitors Card and the Cardholder customer code number.

 

 

International Visitor Card Privacy Policy

(pursuant to the  EU General Regulation 2016/679 on the processing of personal data “GDPR”)

Rinascente S.p.A. (hereinafter “Rinascente”) with headquarters in Milan, Via Washington 70, 20146, is the Data Controller of the personal data collected through membership and use of the International Visitors Card.

Rinascente will proceed with the processing in accordance with the regulations in force and as set out below.

 

1. Categories of personal data collected and used

In addition to the personal data you directly provide when applying for the International Visitor Card (hereinafter, the “Card”), through the online form or directly at one of the Rinascente stores (such as personal data, contact data, etc.) Rinascente collects and uses the following categories of personal data:

● The volume of expenditures progressively made with the Card, as well as further information about the date and place of purchase and the product purchased.

● Personal data that you spontaneously provide by sending requests to or contacting our customer service (e.g. contact details).

● Personal and contact data related to your participation in events, promotions and contests.

 

2. Purpose and legal basis for the processing of personal data

The personal data specified above will be used on paper and electronically, also with the aid of electronic and digital means, according to the principles of necessity, lawfulness, propriety, proportionality, and transparency for the purposes and according to the conditions of lawfulness (so-called legal bases) specified below:

 

i. Issue of the International Visitors Card and provision of related benefits and services: your personal data, contact data and delivery data are used by Rinascente to issue your International Visitors Card and allow you access to all the benefits reserved for cardholders (discounts, promotions, participation in competitions, invitations and participation in events and other benefits described in the International Visitors Card regulations) and to provide you with assistance if requested by you through Rinascente customer service. In addition, personal data and contact data are processed in order to allow Rinascente to send you service communications relating to International Visitors Card, including purchases associated with its use. The legal basis for such processing is the performance of the contractual obligations contained in the International Visitors Card regulations.

 

ii. Profiling activities: personal data, contact data, purchase data relating to the volume of expenditure and are processed in order to analyze your consumption habits and carry out analysis and market research to improve the commercial offer of Rinascente. The legal basis for such processing is your consent. The consent can always be revoked freely within the personal area of the Customer on the Website, or by contacting the customer service of Rinascente, or in store with the support of the staff.

 

iii. Marketing Activities: personal data, contact data are used by Rinascente to send you through the channels authorized by you - such as, for example, telephone, mail or electronic communications, e-mail, sms, digital platforms - marketing communications. Marketing activities may also be carried out through the sharing of your personal data with digital platforms (including those operated by the company "Meta"), as part of campaigns such as "Custom Audience CRM". In this way, you may be addressed in the spaces on the pages of the digital platforms, the advertisements of Rinascente.

The legal basis for such processing is your consent given during registration, or subsequently, directly on the Site or in stores. The consent can always be revoked freely within the personal area of the Customer on the Site, or by using the "unsubscribe" link at the bottom of all communications sent by email, or by contacting the customer service of Rinascente, or by requesting such an update in store with the support of the staff.   

If you have given your consent for the purposes under (ii) and (iii) above (marketing and profiling activities), Rinascente may send you targeted commercial offers, such as promotions and invitations tailored to you and your preferences, on the basis of the profiling and analysis of your data.

Profiling and marketing activities may also be carried out on the basis of the cookies used on the Site, as explained in more detail in the relevant notice.

 

iv. Exercise of the right of defence: personal data are also processed to allow Rinascente to manage any conduct in violation of the provisions of the International Visitors Card regulation and to protect its rights in court. The legal basis for such processing is the need to pursue the legitimate interest of Rinascente (compliance with the provisions of the International Visitors Card regulation and the need for protection in court). This legitimate interest does not affect the rights and freedoms of customers because the treatment is necessary for the exercise of the right of defence constitutionally guaranteed.

 

v. Fulfilment of legal obligations: personal data are processed in order to fulfil obligations imposed by laws or regulations or orders from competent authorities. The legal basis for such processing is the need to fulfil a legal obligation.

 

3.Nature of the provision of personal data

With respect to the purposes set out in paragraph 2., points i and ii, the provision of the data marked with an asterisk when requesting the issue of the Card is compulsory under the relevant regulations and failure to provide such data, incomplete or untruthful communication will result in the Card not being issued or being revoked. The provision of data on the volume of expenditure is also compulsory in order to allow you to access the exclusive benefits reserved for cardholders (e.g. reaching a certain spending threshold allows the cardholder to participate in prize competitions) and failure to provide it will result in the impossibility of taking advantage of the above-mentioned benefits. The provision of personal data other than those indicated above is optional and any refusal to provide such data will result in the impossibility, even partial, of pursuing the purposes indicated above. 

 

4. Recipients of personal data and transfer of personal data

For the pursuit of the aforementioned purposes, your personal data will be processed by authorized Rinascente personnel (including the pro-tempore manager of the store where the data were collected, sales staff and authorised personnel of the Marketing Department and Information Systems Department, Customer Service and Omnichannel Division), as well as authorized personnel of third parties who act as data processors (IT service providers and customer service providers, suppliers offering CRM solutions, companies offering data entry and mailing services, brands and, in the case of participation in prize competitions or events, companies dealing on behalf of Rinascente with the organization and management of competitions and events, companies appointed to send promotional communications, including digital platforms which process personal data on our behalf in the context of marketing activities (such as Meta during the Custom Audience CRM campaigns). 

Where strictly necessary for the pursuit of the aforementioned purposes, your personal data may also be communicated to autonomous third-party data controllers such as, purely by way of example, the competent Authorities (for example, in the event of a report of theft of the Card or management of litigation), notaries and chambers of commerce (in the event of participation in prize competitions) or PR companies (for participation in events). Further information on the recipients of the data is available by contacting the Controller at the addresses indicated in this notice.

 For specific needs related to the location of the servers of Rinascente and/or its suppliers, Rinascente makes use for the provision of services also of suppliers - as Data Processors - located in third countries outside the European Economic Area. In this case Rinascente undertakes to ensure adequate levels of protection and safeguard also through contractual agreements, including the stipulation of standard contractual clauses pursuant to Article 46 of the GDPR, where applicable.

 

5. Data Retention

Rinascente retains your personal data for the time strictly necessary to pursue the above-mentioned purposes in compliance with civil and fiscal retention obligations and within the limits provided for by law. To this end, Rinascente specifies that:

 

i. personal data processed for the purpose of obtaining the International Visitors Card and the provision of related benefits and services, and the sending of service notices will be retained for a period of 10 years from the revocation of the International Visitors Card and the related contract under which the above-mentioned processing is carried out, in accordance with the provisions of the statute of limitations.

ii. personal data processed for marketing and profiling activities will be retained, in any case, for a period of 7 years from the date of acquisition of consent. The Customer may in any case revoke his/her consent as specified in Paragraph 2 above.

ii. Personal data processed for the exercise of the right of defence will be retained in accordance with the provisions of the statute of limitations regarding torts of a contractual/extracontractual nature.

iv. Personal data processed for the fulfilment of legal obligations will be processed for as long as required by the legal regulations with which Rinascente must comply.

 

6. Your rights

As a data subject, pursuant to Articles 15 et seq. of the Regulation you have the right to:

● receive confirmation of the existence of your personal data, access their content and obtain a copy (right of access);

● update, amend and/or correct your personal data (right of rectification);

● request the deletion or restriction of the processing of data in the cases provided for in the Regulation, including where the data have been processed in breach of the law or where storage is not necessary in relation to the purposes for which the data were collected or otherwise processed (right to erasure and right to restriction);

● revoke consent, where given, at any time and without prejudice to the lawfulness of the processing based on the consent given before revocation (right to withdraw consent);

● to the extent provided for in the Regulation, receive a copy of the data you have provided in a structured, commonly used and machine-readable format and request that such data be transmitted to another data controller if technically feasible (right to data portability);

● You also have the right to object at any time to the processing of your data for direct marketing purposes including profiling insofar as it is related to such direct marketing and where the processing is based on legitimate interest - p. 2 lett. d (right to object).

 When contacting us, you must include your name, e-mail address, postal address and/or telephone number if provided, and your International Visitors Card number, in order to handle your request correctly.

We would like to remind you that requests for deletion of data are subject to existing legal and regulatory obligations regarding the retention of documents.

We would like to remind you that for the management of consents where given (including revocation) and for the modification or updating of your personal data and your profile, you can access your reserved area at any time and use the functionalities available in the “My Details” section. 

You may at any time lodge a complaint with the supervisory authority in the event of a breach of data protection regulations. For further information:
